01. WEBSITE REGISTRATION

When you place an order, or register as a customer, the personal information which you are required to provide must be true, accurate, current and complete in all respects. 02. INDEMNITY

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of conditions by you or any other liabilities arising out of your use of this website, or by the use of any other person accessing the website using your shopping account and/or your personal information.

03. PRICES & PAYMENT

Prices for products displayed on the website are in US Dollars (USD) and exclude any delivery charges. We reserve the right to amend prices at any time. Should the occasion arise that the incorrect price for a product is displayed on the website due to a system glitch or human error, we reserve the right to cancel any orders made for products at the incorrect price and refund all monies that have been paid. We are not obliged to honor the incorrect price in any future orders. In the unlikely event that this should occur we will contact you to advise of this as soon as possible. You must pay in full for the products (including any applicable delivery charges) at the time of placing your order. We endeavor to provide you with an accurate shipping cost at the time you place your order. We do, however, sell some large and heavy products that may require a more specialized delivery service than our regular two-man furniture delivery. Once you have placed your order, we will contact you to advise you of any extra cost involved in delivery before we continue to process your order. Ownership in the products we supply to you will not pass until we have received all sums due (including delivery charges).

04. CANCELLATION AND RETURNS

Our goal is for you to be fully satisfied with your purchase. If, for any reason, the products you receive do not live up to your expectations, we are open to exchanging them for another item of equivalent value. Please note, however, that we do not accept returns unless the item is delivered in a damaged or faulty condition.

Cancellation Policy: Once an order is placed, we are unable to offer returns or refunds. This policy is strictly applied to custom orders, which are final and cannot be changed or canceled.

Damages/Defects: If your items arrive damaged or with defects, it is crucial to report these issues within [time] of delivery. We will work with you to resolve these issues promptly.

05. DELIVERY

When your order is shipped from our warehouse via courier, we will send you a dispatch confirmation email containing tracking information. For products being delivered by our delivery team (i.e. larger furniture items), you will be contacted in advance to arrange a convenient date to deliver your order. A delivery can only be arranged once any outstanding balance has been settled. For home delivery service, our delivery team will deliver the goods to the room of your choice and, if required, will unpack, take away the packaging, assemble the goods and place in situ. You or your representative accepting the delivery will be asked to sign the Delivery Note. Please ensure that you or your representative have inspected the goods thoroughly before signing as Sungai Design cannot be held liable for any damage reported once the delivery team has left the premises.

Should there be any problem with your delivery please contact us at contact@sungaidesign.com before the delivery team leaves and they will work on a solution to resolve the problem. Please record any problems on the delivery note. If you are receiving a courier or drop off service you should only accept and sign for the goods if the packaging is undamaged. Any claims for damage to the goods must be reported at the moment of delivery by emailing contact@sungaidesign.com. Failure to make such claims within the specified time constitutes acceptance of the merchandise and quality of the goods. If you are not accepting the delivery, please ensure that this is recorded on the delivery note and you contact our Customer Service team so we can work on resolving the problem.

06. PRODUCT DESCRIPTIONS

Unless explicitly stated, all our goods are suitable only for indoors use. Sungai Design takes all reasonable care to ensure that the product descriptions and details appearing on the Website are correct at the time that the product was first published on the website. Although we aim to keep the Website as up to date as possible, the information at any particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy. While every effort has been made to portray items accurately through detailed imagery, variations may occur. Reproduction of colors is as accurate as photographic and publishing processes will allow and there may be variations in colours dependent on the calibration and settings of individual screens or browsers.

If you purchase the same goods under two or more orders, we cannot guarantee that the goods supplied will be from the same batch and be an exact color match. All materials are recycled materials and as such there are natural variations in the color, grain and texture over which Sungai Design has no control and cannot guarantee that the goods you receive will be exactly as the display product, website or catalog image. All measurements given are approximate.

07. INTELLECTUAL PROPERTY & RIGHTS TO USE

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors. You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose.
